Tour Operator

is Sistemas Informáticos Ltda. RUT 77.259.720-7 (hereafter called Patagonia Backroads), Avenida España 1032, Punta Arenas, Región de Magallanes, Chile.

Booking Form
To make a booking please fill in our booking form on the homepage. By signing the booking form the client accepts the Terms and Conditions as binding for the contract between Patagonia Backroads (PB) and him, the participant. Patagonia Backroads (PB) does not accept any tour participant without a signed booking form. It is the clients’ responsibility to carefully read the Terms and Conditions.

Rental, Waiver and Deposit authorization forms
On arrival every participant of a tour operated by Patagonia Backroads (PB) is required to accept and sign a rental contract for motorbikes (motorbike tours only), a release and waiver form as well as a deposit authorization form (motorbike tours only) before tour start. PB will not accept any tour participant without signing these above mentioned forms. A copy of these forms can be requested before arrival from PB.

Booking Deposit
When booking a tour PB requires a deposit of US$ 1000 / EUR 750 for motorbike tours and 500 USD / 375 EUR for Land Rover tours , 90 days before the tour starts. This deposit secures a place on the tour. The rest amount is due 30 days before the tour starts.

Motorcycle Rental and Deposit
When booking a motorbike tour, the package includes the rent of a motorcycle. The motorbikes are all BMWs of different types, all with luggage cases or backrests and tank bags. With the booking form the client sends in a request for a motorbike type, which PB if possible will confirm. PB however reserves the right to change the confirmed motorbike if circumstances occur that are beyond its influence such as mechanical failure, collision, damage and theft. In such a case PB will refund the rental difference in models to the participant. During the tour PB is not obliged to replace a damaged motorcycle.

Single Supplement
Without special mention tour includes accommodation in twin or double room. Single rooms are available at an extra cost; participant must request single room when sending the booking form. A single traveler may request to stay in a twin room with another tour participant so that single supplement does not apply. If no other tour member is available to share a room, PB reserves the right to charge the single supplement. On the other hand, PB also reserves the right to put a participant requesting single accommodation in a room with another tour member if no single rooms are available.

Meals
Depending on the tour all or some meals can be included. Breakfast is always included as part of the accomodations. And proper dinner is guaranteed to be provided either when is included on the price paid or not. Lunch available may consist of either a hot meal or sandwiches; however under special circumstances it may occur that there is no time for lunch and that time is too short even for sandwiches. Special circumstances can be damage or collision of vehicles or any sort of mechanical problem, tough weather conditions (e.g. difficult river-crossing) or other reasons. Under these terms PB will make sure that there is some emergency snack available.

Luggage
Baggage on all our tours is strictly limited to one large bag (dry bag or backpack). The maximum weight is 15 kg for motorbike tours plus extra riding gear and 20 kg for Land Rover tours. Suitcases will not be permitted! PB will offer individual dry bags if needed.  

Cancellation procedure
There is a cancellation fee of 100 USD / 75 EUR that applies in any case. Furthermore cancellation costs depend on the exact date of cancellation. The client is obliged to notify PB in writing of cancellation. The cost of annulations is show below:
For motorbike tours:
• up to 61 days before tour starts 500 USD / 375 EUR
• 60 – 31 days before tour starts 1000 USD / 750 EUR
• 30 – 0 days before tour starts full fare

For Land Rover tours:
• up to 61 days before tour starts 350 USD / 260 EUR
• 60 – 31 days before tour starts 700 USD / 525 EUR
• 30 – 0 days before tour starts full fare

If a client fails to join a tour or joins after departure, or leaves prior to tour end, or if tour is cancelled or delayed as a result of Acts of God (including fire, flood, earthquake, storm, hurricane or other natural disaster), war, invasion, act of foreign enemies, hostilities (regardless of whether war is declared), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalisation, government sanction, blockage, labor dispute, strike, lockout or interruption or failure of electricity or telephone service , no refund will be made. This cancellation policy will be followed strictly, no exceptions will be made. It is strongly recommended to the client to have trip cancellation insurance.

Rebooking
Rebooking is possible only under special circumstances and upon agreement with PB. For instance there should be another guaranteed tour available with free places and dates should suit the client. In any case of rebooking a fee of 200 USD / 150 EUR will be charged. PB reserves the right to refuse rebooking, if not able to accommodate a rebooking request. Must client therefore cancel his tour the usual cancellation procedure will apply.

Tour Cancellation
To guarantee a tour a minimum of 6 participants for motorbike tours and 4 passengers for Land Rover tours is needed. If the minimum number is not reached 30 days prior to tour start PB has the right to cancel this tour. PB usually offers to operate the tour at an extra cost. All clients have to agree to this supplement; otherwise the tour will be cancelled and full refund made to client. Beyond this PB does not take any liability for further costs or losses for the client due to tour cancellation (e.g. airline tickets, hotel reservation etc.).

Tour Changes
There may be reasons that make it necessary for PB to re-schedule a tour, change itineraries or make changes regarding accommodation, route, tour guides or other tour details. Under these circumstances PB does not take any responsibility for following losses, expenses or inconvenience. Under no circumstances will there be any refunds once tour has commenced, regardless of the reason for participant’s being unable to complete his or her tour.

Weather Conditions
Patagonia is one of the most extreme areas of the world and has very rough weather conditions. It is essential to be well prepared for fast changes of weather conditions and to bring along flexibility for any consequences that may result thereof. PB cannot be made liable for rough weather conditions and its consequences for a tour.

Participation and Rules
Participants are asked to understand the character of group travelling; its necessity to follow certain rules and to bring along flexibility and willingness to share an experience and time with others. The degree of satisfaction and enjoyment you feel at the end of each day and the end of the trip will depend on you and your capacity to enjoy yourself. Group members are required to consider the following basic rules:
• never drive ahead of tour guide (unless otherwise declared)
• follow instructions given by tour guide
• do not endanger other tour members or continuation of tour by any actions
• do not act against any local laws
• to join our tours you need common sense, an adventurous spirit and a good deal of humor 

Exclusion
The participant is required to conform to traffic laws, to strictly observe discipline during the tour and shall strictly follow all of the indications of the organizing personnel. If a client acts in contrary to above mentioned points PB may at any time exclude this person from the tour and cancel the contract and shall have no liability for this decision.

Passport, Visa and Law
The client is responsible for conforming to Passport and Visa regulations; also is he accountable for law-abiding behavior. All consequences resulting from non-compliance will be borne by the customer.

Insurance
Adequate travel, cancellation, accident and health insurance are mandatory for the client and have to be organized beforehand. These should cover in the event of cancellation or curtailment, death, any medical or rescue expenses, as well as for any loss of baggage, money or personal items.

Responsibility and Conditions
PB takes responsibility of providing the services of a tour as listed in tour description and confirmation, but reserves the right to change any part of the program if circumstances require such actions. It is understood that all tours are prepared with care. PB is responsible for constantly checking suppliers as hotels and restaurants and makes a careful selection thereof. PB takes no liability for any accidents, nor any injury, death or other damage to the customer. If a client files a lawsuit against PB, he herewith agrees to do so solely in the city of Punta Arenas and furthermore agrees that the substantive law of the Republic of Chile applies in that action without regard to the conflict of law rules of other countries.
